What is the Madrid System?

Among the alternatives for trademark registration, the most economical and easily sustainable one is the international trademark registration, provided that the trademark does not encounter any refusal or opposition. Another advantage of the system is that, following the initial determination made between member states, the scope of protection can be expanded by selecting additional member states once the international registration number is assigned.

Turkey became a party to the Madrid Protocol concerning the International Registration of Marks on January 1, 1999. Under this protocol, Turkish citizens, residents of Turkey, or those engaged in commercial or industrial activities in Turkey can apply for international trademark registration in over 100 countries that are parties to the Madrid Protocol through the Turkish Patent and Trademark Office.

For an international application to be made, the applicant must have a pending application or registration in the home country, and due to this requirement, the international application is dependent on the registration in the home country for a period of five years from the registration date.
